Discovery—Authority of presiding officer.
(1) Discovery in adjudicative proceedings other than as enumerated in WAC
16-08-061 through
16-08-121 may be permitted at the discretion of the presiding officer. In permitting such discovery, the presiding officer shall make reference to the civil rules of procedure.
(2) The presiding officer shall have the power to control the frequency and nature of discovery permitted, including discovery as enumerated in WAC
16-08-061 through
16-08-121, and to order discovery conferences to discuss discovery issues.
