Subject of Possible Rule Making: Chapter 172-125 WAC, Discrimination and Title IX violations by students.

Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 28B.35.120(12).

Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: On January 9, 2025, a federal district court vacated the 2024 Title IX regulations. Per a "Dear Colleague Letter" issued by the Department of Education, Eastern Washington University must modify its rules to comply with the 2020 Title IX regulations.

Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: These changes are being made to comply with a recent court decision and directives issued by the United States Department of Education.

Process for Developing New Rule: Negotiated rule making.
