(1) Under chapter 26.23 RCW, employers must report lump sum payments over $500 for employees subject to an income withholding for unpaid child support debt.
(2) The employer provides notice of the lump sum payment by reporting to:
(a) The electronic employer services portal provided by the federal office of child support services;
(b) The special collections unit at the division of child support (DCS); or
(c) DCS at the contact information noted on the income withholding order form.
(3) Upon notice of a lump sum payment, DCS will respond to the employer within 14 calendar days by sending either:
(a) A written release of all or part of the payment which may be disbursed to the employee; or
(b) A revised supplemental income withholding order or other request specifying the remittance to DCS.
(4) Failure to provide timely notice of a lump sum payment as required may constitute noncompliance under RCW 74.20A.350.
(5) Employers may report lump sum payments in an amount of $500 or less to DCS.
(6) DCS and employers may establish a reporting process or agreement that meets or exceeds the lump sum payment reporting requirements under chapter 26.23 RCW.
